SECTION 1 — AGREEMENT TO TERMS

By accessing or placing an order through kksweetsboutique.net or any associated social media channels, you agree to be bound by these Terms of Service. These terms apply to all customers, visitors, and users of KK Sweets Boutique. If you do not agree to these terms, please do not place an order or use our services.

KK Sweets Boutique is owned and operated by Keyanna Montague, a mobile bakery business based in Jacksonville, Florida, shipping nationwide.

SECTION 2 — PRODUCTS & ORDERS

All products offered by KK Sweets Boutique are handmade food items prepared fresh to order. By placing an order, you acknowledge and agree to the following:

• All orders are subject to availability and confirmation.
• We reserve the right to refuse or cancel any order at our discretion.
• Product photos are representative — slight variations in appearance may occur due to the handmade nature of our items.
• Custom and branded orders require full details to be submitted via email before production begins.
• A minimum order of 10 jars per bundle applies to all cake jar orders.

SECTION 3 — PRICING & PAYMENT

All prices are listed in U.S. dollars and are subject to change without notice. KK Sweets Boutique reserves the right to modify pricing at any time. The price in effect at the time of your order confirmation is the price you will be charged.

• Full payment is required before production begins on any order.
• Rush orders are subject to an additional $60 fee.
• Corporate and bulk order pricing may vary — contact us for a custom quote.

SECTION 4 — CUSTOM & BRANDED ORDERS

Custom and branded cake jar orders — including but not limited to graduation, corporate, event, and personalized label orders — are subject to the following terms:

• All custom order details (name, school, mascot, colors, photo, shipping address) must be submitted via email to kksweetsboutiquellc@gmail.com.
• Production begins only after all required details are received and confirmed.
• The customer is solely responsible for the accuracy of all submitted details. KK Sweets Boutique is not liable for errors in customer-provided information.
• Custom orders are non-refundable and non-cancellable once production has begun.
• Turnaround time for branded orders is 3–4 business days after all details are received.

Please review all custom details carefully before submitting. Once production begins, changes cannot be made.

SECTION 5 — SHIPPING & DELIVERY

KK Sweets Boutique ships nationwide across all 50 states. By placing an order, you agree to the following shipping terms:

• Standard branded cake jar orders ship within 3–4 business days after receipt of all order details.
• Standard KK-branded cake jars ship within 2 business days.
• Shipping times are estimates and are not guaranteed. Carrier delays are outside our control.
• Once an order is handed off to the carrier, KK Sweets Boutique is not responsible for delays, losses, or damages caused by the carrier.
• The customer is responsible for providing a complete and accurate shipping address. KK Sweets Boutique is not liable for orders delivered to an incorrect address provided by the customer.
• Orders shipped outside of Duval County, Florida are subject to standard carrier shipping rates.

SECTION 6 — RETURNS, REFUNDS & CANCELLATIONS

All sales are final. Due to the perishable and handmade nature of our products, we do not accept returns or offer refunds once an order has been received in good condition. Please refer to our full Return & Refund Policy for complete details on damaged orders, cancellations, and claims.

SECTION 7 — FOOD ALLERGENS & SAFETY

All KK Sweets Boutique products are prepared in accordance with the Florida Cottage Food Law (Florida Statute § 500.80). Our products may contain or come into contact with common allergens including but not limited to:

• Wheat / Gluten
• Dairy / Milk
• Eggs
• Tree nuts and peanuts
• Soy

KK Sweets Boutique is not a certified allergen-free facility. Customers with food allergies or dietary restrictions purchase at their own risk. Please contact us before ordering if you have specific allergen concerns.

In compliance with Florida Cottage Food Law, our products are not subject to Florida's food safety regulations. This label is required by law: "Made in a cottage food operation that is not inspected by the Department of Agriculture and Consumer Services."

SECTION 8 — INTELLECTUAL PROPERTY

All content on kksweetsboutique.net and KK Sweets Boutique social media pages — including but not limited to logos, photos, product images, branding, and written content — is the intellectual property of KK Sweets Boutique and Keyanna Montague. Unauthorized use, reproduction, or distribution of any content without written permission is strictly prohibited.

SECTION 9 — PRIVACY

KK Sweets Boutique collects personal information (name, email, phone number, shipping address) solely for the purpose of processing and fulfilling your order. We do not sell, rent, or share your personal information with third parties. Your information is kept confidential and used only to serve you better.

SECTION 10 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, KK Sweets Boutique and Keyanna Montague shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of our products. Our total liability to any customer shall not exceed the amount paid for the specific order in question.

SECTION 11 — CHANGES TO THESE TERMS

KK Sweets Boutique reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to kksweetsboutique.net. Continued use of our website or services after any changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.

SECTION 12 — GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Duval County, Florida.
